<p>Las estadísticas por muertes en accidente en el puesto de trabajo llenan un día si y otro también los titulares en los medios de comunicación. Ante esta triste realidad "Checa Abogados", el despacho especializado en accidentes laborales <a href="http://www.checaabogados.es">www.checaabogados.es</a> quiere destacar que el dolor de este fatal desenlace así como el desconocimiento legal provocan que en muchas ocasiones los familiares o personas cercanas a las víctimas no reclamen cantidades como daños y perjuicios independientes de las prestaciones de Seguridad Social que puedan corresponderles. "Cantidades a las que se tiene derecho en los casos en los que exista responsabilidad civil por culpa del empresario en la causación del accidente laboral que haya provocado el fallecimiento de trabajador y cuyas reclamaciones son amparados legalmente", dice Marta Checa García, Directora de Checa Abogados.</p>]]>
        <![CDATA[<p>Para ayudar a reclamar las diferentes cuantías que puedan corresponder en cada caso Checa Abogados destaca que lo primero que se ha de tener en cuenta es algo tan básico como quién puede resultar perjudicado por la muerte de un trabajador. "Ha de entenderse como perjudicada aquella persona ligada con la víctima por vínculos familiares, de afecto, de convivencia real, de dependencia y otras situaciones que determinen perjuicios reales derivados de la muerte producida por culpa de la empresa, ahora bien, este derecho no siempre coincidirá con la figura de heredero legal, aunque generalmente así será", subraya dicha abogada.<br />
<strong><br />
Baremos de Tráfico para accidentes laborales</strong><br />
A la hora de establecer qué cantidades corresponden en cada situación, Marta Checa García explica que lo normal es que se use el baremo existente para fijar las cuantías indemnizatorias respecto a accidentes de circulación para la reclamación del daño moral, en cuyo contenido se fijan las categorías de perjudicados. "La Tabla I de dicho Baremo, establece una serie de perjudicados que consisten en el cónyuge, los hijos, los padres y hermanos menores, huérfanos y dependientes de la víctima, los cuales pueden concurrir en la indemnización, esto es, pueden solicitarla todos ellos, si bien las cuantías son distintas, fijando también a los hermanos sin convivencia con el fallecido cuando no existan cónyuges, hijos y padres del mismo", explica Marta Checa García.</p>

<p>Además Checa Abogados también aclara que pueden tener la condición de perjudicada la pareja consolidada sin haber contraído matrimonio, en algunas ocasiones el cónyuge separado legalmente si dependiera económicamente del fallecido (pensiones compensatorias vitalicias), incluso otros supuestos distintos. "Existe algún antecedente jurisprudencial en el que también se ha tenido en cuenta como perjudicado al nieto del fallecido por no tener ingresos y convivir con éste, a un hermano mayor de edad del fallecido compañero de éste y testigo presencial del accidente que sufrió por ello trastornos psicológicos, habrá que analizar cada supuesto" recalca.</p>

<p><strong>Qué hay del dinero<br />
</strong>A la hora de hablar de la indemnización, las cuantías que se establecen en dicho Baremo resarcen en un primer lugar el daño moral provocado por el fallecimiento. "El daño moral viene a definir el sufrimiento o el dolor de los seres cercanos, estableciendo cantidades ya prefijadas según el grado indicado. Estas cantidades tienen en cuenta la edad del fallecido y en el caso de los hijos, también la edad de éstos y su dependencia económica", comenta Marta Checa García.</p>

<p>Así mismo Checa Abogados recuerda que en caso de fallecimiento de un familiar en accidente laboral cabría también la reclamación del daño patrimonial. "Esto es, todos los gastos del sepelio, así como el lucro cesante, o lo que es lo mismo las pérdidas de ganancias para los perjudicados que vivían y dependían económicamente del fallecido, piénsese en la disminución de ingresos que suponen las pensiones de viudedad y orfandad, que no alcanzan a satisfacer el perjuicio económico sufrido en su totalidad, daño respecto al cual los perjudicados podrán apartarse del Baremo de Circulación y solicitar la cantidad que corresponda, eso si, con una acreditación certera y veraz de dicho perjuicio".</p>

<p>Por todo ello y para facilitar al menos este resarcimiento económico Checa Abogados aconseja siempre ponerse en manos de abogados expertos en materia de riesgos laborales. "Es importante acudir a consultores especializados dada la concurrencia de distintas vías indemnizatorias, pudiéndose perder que no se cubra la totalidad del daño producido, cuantías económicas que aunque no resarzan nunca la falta de un ser querido, ayudan materialmente a sobrellevar en lo económico la situación", finaliza Marta Checa García, Directora de Checa Abogados.</p>]]>

        <![CDATA[<p><a href="http://www.negocios.biz/">Negocios</a> - Anchor babies" isn't a very endearing term, but in Arizona those are the words being used to tag children born in the U.S. to illegal immigrants. While not new, the term is increasingly part of the local vernacular because the primary authors of the nation's toughest and most controversial immigration law are targeting these tots - the legal weights that anchor many undocumented aliens in the U.S. - for their next move.</p>]]>
        <![CDATA[<p>Buoyed by recent public opinion polls suggesting they're on the right track with illegal immigration, Arizona Republicans will likely introduce legislation this fall that would deny birth certificates to children born in Arizona - and thus American citizens according to the U.S. Constitution - to parents who are not legal U.S. citizens. The law largely is the brainchild of state Sen. Russell Pearce, a Republican whose suburban district, Mesa, is considered the conservative bastion of the Phoenix political scene. He is a leading architect of the Arizona law that sparked outrage throughout the country: Senate Bill 1070, which allows law enforcement officers to ask about someone's immigration status during a traffic stop, detainment or arrest if reasonable suspicion exists - things like poor English skills, acting nervous or avoiding eye contact during a traffic stop. <p>But the likely new bill is for the kids. While SB 1070 essentially requires of-age migrants to have the proper citizenship paperwork, the potential "anchor baby" bill blocks the next generation from ever being able to obtain it. The idea is to make the citizenship process so difficult that illegal immigrants pull up the "anchor" and leave. (See pictures of the Great Wall of America.)</p>

<p>The question is whether that would violate the U.S. Constitution. The 14th Amendment states that "all persons, born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States." It was intended to provide citizenship for freed slaves and served as a final answer to the Dred Scott case, cementing the federal government's control over citizenship.</p>

<p>But that was 1868. Today, Pearce says the 14th Amendment has been "hijacked" by illegal immigrants. "They use it as a wedge," Pearce says. "This is an orchestrated effort by them to come here and have children to gain access to the great welfare state we've created." Pearce says he is aware of the constitutional issues involved with the bill and vows to introduce it nevertheless. "We will write it right." He and other Republicans in the red state Arizona point to popular sympathy: 58% of Americans polled by Rasmussen think illegal immigrants whose children are born here should not receive citizenship; support for that stance is 76% among Republicans.</p>

<p>Those who oppose the bill say it would lead to more discrimination and divide the community. Among them is Phoenix resident Susan Vie, who is leading a citizen group that's behind an opposing ballot initiative. She moved to the U.S. 30 years ago from Argentina, became a naturalized citizen and now works as a client-relations representative for a vaccine company. "I see a lot of hate and racism behind it," Vie says. "Consequently, I believe it will create - and it's creating it now - a separation in our society." She adds, "When people look at me, they will think, 'Is she legal or illegal?' I can already feel it right now." Vie's citizen initiative would prohibit SB 1070 from taking affect, place a three-year moratorium on all related laws - including the anchor baby bill - to buy more time for federal immigration reform. Her group is racing to collect 153,365 signatures by July 1 to qualify for the Nov. 2 general election.</p>

<p>Both sides expect the anchor baby bill to end up before the U.S. Supreme Court before it is enacted. "I think it would be struck down as facially unconstitutional. I can't imagine a federal judge saying this would be OK," says Dan Barr, a longtime Phoenix lawyer and constitutional litigator. Potentially joining the anchor baby bill at the Supreme Court may be SB 1070, which Arizona Republican Governor Jan Brewer signed into law in April. It is set to take effect July 29, but at least five courtroom challenges have been filed against it. Pearce says he will win them all.</p>]]>

        <![CDATA[<p>By Moses Apsan - Washington D.C. March 20 -  It seems that the entire nation is preparing for Sunday's immigration reform march and rally at the Washington Mall.  Buses from the four corners  of the country, are already leaving by the hundreds. People of every race religion and creed have one thought in mind: "comprehensive immigration reform." </p>]]>
        <![CDATA[<p>Yesterday, after a Machiavellian move on the part of Illinois representative Luis Gutierrez, President Obama  promised to help push bipartisan comprehensive immigration reform legislation forward and faster than you can say "Si Se Puede" Sens. Lindsey Graham and Charles Schumer released their blueprint for immigration reform. Followed closely by Senator Leahy , promising support and Senator Reid who pledged to make room this year for the legislation on the floor.</p>

<p>It was just this past Thursday when Obama met at the White House with Reps. Luis Gutierrez  and Solomon Ortiz, the sponsors of a House immigration bill. Gutierrez made a statement  later that  he agreed to vote for Obama's signature domestic bill, health care reform, only if a comprehensive immigration reform bill advanced quickly and with a presidential imprimatur. The Congressional Hispanic Caucus joined the endorsement of the health care bill.</p>

<p>Reid Cherlin,  White House spokesman, announced that there was no quid pro quo involved in the White House's discussions with Gutierrez. "Congressman Gutierrez is a longtime leader of the reform effort on the Hill, so of course they've had many conversations about it, and they'll continue to," Cherlin said.</p>

<p>Obama's proclamation and the senators' blueprint  were strategically aligned  to reach the media before  Sunday's  rally.  A rally that is expecting to attract  tens of thousands of people to Washington to convince  the administration and Congress that time is ripe for comprehensive  immigration reform.</p>

<p>Immigrants and citizens alike have become disillusioned by Obama's inaction after his campaign promise to make immigration reform  of primary importance in his first year of office. So far he has done little in the way of immigration reform and instead, because of federal inaction, local vigilantes, like  Maricopa County Sheriff Joe Arpaio who recently announced plans to launch his 14th raid in the last two years, have attacked undocumented immigrants as if  all 11 million were deranged terrorists.</p>

<p>Hoping to steer clear of an impending catastrophe, Obama conceded to Gutierrez's threats to vote no on health reform and instead of hearing unflattering epithets  this Sunday, he will hear once  again "Si se puede."</p>]]>

        <![CDATA[<p>March 2008--Hispanics are concerned about the treatment of immigrants in the United States, both in terms of immigration policy and the way they are portrayed in the media. Nevertheless, six in ten feel that Hispanic immigrants should "follow the rules and come to the U.S. legally."</p>

<p>Contrary to how they are portrayed by anti-immigration activists, a majority of respondents -- particularly more recent immigrants -- feel strongly that immigrants have an obligation to learn English. Despite a desire to integrate, nearly half of Hispanics worry about themselves or family members being deported. </p>]]>
        <![CDATA[<p>A new study conducted by Los Angeles based multicultural research firm New American Dimensions suggests that companies -- or candidates during this election year -- that openly support the rights of Hispanic immigrants are likely to garner favor with this segment, the largest minority group in the United States. The survey consisted of a telephone survey of 1,000 Hispanic respondents between the ages of 18 and 64. Highlights of the study, which is available at http://www.newamericandimensions.com, include:</p>

<p>-- Despite common perceptions to the contrary, Hispanic immigrants were significantly more in agreement than those born in the U.S. that immigrants should learn English if they plan to stay in this country. 80% of the foreign born agreed, compared to only 60% of the U.S. born.</p>

<p>-- Half of respondents felt that "Hispanics are often treated like second class citizens in the U.S." One-half of respondents also agreed that the media does a very poor job of showing the Hispanic experience in America.</p>

<p>-- Seven in ten feel that illegal immigration has benefited the U.S. economy and six in ten feel that it has benefited U.S. society overall. Six in ten felt that the United States has a moral obligation to grant amnesty to illegal immigrants.</p>

<p>-- Half of Hispanic adults, about one in five Hispanic immigrants, are U.S. citizens. Among citizens, 83% expressed an intention to vote in November. Of the non-citizens, seven in ten stated that the recent debate about immigration has made them more interested in pursuing citizenship.</p>

<p>-- 55% of Hispanic citizens consider themselves Democrat, 24% Independent and 13% Republican. When asked for whom they would vote if the U.S. presidential election were held today, 36% said Hillary Clinton, 21% Barack Obama and 6% John McCain.</p>

<p>"Our study demonstrates that the notion that Hispanics do not want to integrate into U.S. society is erroneous," said David Morse, President and CEO of New American Dimensions, which provides customized multicultural consumer research.         <![CDATA[<p><a href="http://www.abogada.com/abogados/Lawyers/">Latino Lawyer Info</a> - Julie Myers had cleared every hurdle in her quest to officially become the nation's top immigration official, a dreadlocked wig and a prisoner's outfit could cost her the job.</p>]]>
        <![CDATA[<p>Myers, director of Immigration and Customs Enforcement, ran into trouble earlier this month after she and two other agency managers gave the "most original" costume award to a white employee who came to the agency's Halloween party dressed as an escaped prisoner with dreadlocks and darkened skin.</p>

<p>The incident drew complaints of racial insensitivity and an apology from Myers. It also cast doubt on whether she'll get a confirmation vote before the end of the year, when her original appointment expires.</p>

<p>It would be a stunning collapse for Myers, 38, a native of Shawnee, Kan., who worked hard over the past two years to convince skeptical lawmakers that someone with little immigration experience was up to the task of running the government's second largest investigative force.</p>

<p>With just a few more weeks to go before the end of the session, Senate Majority Leader Harry Reid, D-Nev., has not scheduled a vote on Myers. Spokesman Jim Manley said this week that Reid has "serious concerns" with the nomination and is consulting with other lawmakers about how to proceed.</p>

<p>Myers met resistance in 2005, the first time President Bush tried to appoint her to the Homeland Security Department post, after Democrats and Republicans said she had weak credentials for the high-profile job. To avoid a fight, Bush installed her during a Senate recess and her position expires at year's end unless the Senate votes to confirm her.</p>

<p>Questions about nepotism also came up because Myers is the niece of Air Force Gen. Richard B. Myers, the former chairman of the Joint Chiefs of Staff. She is married to John Wood, the U.S. attorney in Kansas City and former chief of staff to Homeland Security Secretary Michael Chertoff.</p>

<p>Even some of those expected to defend Julie Myers seemed shaky.</p>

<p>"The way things are going, we may not ever vote on her nomination," Sen. Kit Bond, R-Mo., who is a second cousin of Myers' husband, said Friday. "Our nation's immigration enforcement agency needs non-controversial leadership. That would be best served by going in a different direction with this nomination."</p>

<p>Bond's reaction was a surprise, said ICE spokeswoman Kelly Nantel, and Myers is trying to speak with the senator about it.</p>

<p>Despite Bush's decision to circumvent the Senate, it was clear in hearings earlier this year that Myers had won over many doubters with her performance in stabilizing the agency's financial problems and improving its management.</p>

<p>Some key lawmakers have rallied to her defense, including Joe Lieberman, the Connecticut independent who chairs the Senate Homeland Security committee, and Sen. Susan Collins, R-Maine, the panel's top Republican.</p>

<p>"Senator Lieberman regrets her lapse in judgment regarding the Halloween incident," spokeswoman Leslie Phillips said. "He is inclined to support her nomination, given the committee's review of her entire record, the fact that the union representing 7000 ICE employees supports her and her year's experience in office."</p>

<p>Myers has apologized repeatedly for the costume incident, saying she was "shocked and horrified" to learn the employee had altered his skin color and conceding "it was inappropriate for me to recognize any individual wearing an escaped prisoner costume."</p>

<p>"She took very direct steps prior to address what she felt was a bad judgment call, bad decision and to take responsibility for what was an offensive costume worn by an employee," Nantel said.</p>

<p>The employee was placed on administrative leave and Myers issued a formal apology to all ICE employees two days after the episode. She also reached out to a black employees group to express her regrets. The group, the National Association of African-Americans in the Department of Homeland Security, sent a letter to Reid this week praising Myers' commitment to black employees.</p>

<p>Still, it was not the kind of image many lawmakers wanted to see from the agency responsible for arresting and incarcerating illegal immigrants.</p>]]>

En Quitman (Georgia) es ilegal desvestir a las maniquíes de las tiendas sin cubrir antes los escaparates. En Florida las mujeres no pueden saltar en paracaídas solas los domingos si van solas. Incluso en fechas tan señaladas como en San Valentín, en ciudades como Halethorpe (Maryland) el beso en publico solo puede durar un segundo. Éstas sólo son algunas de los cientos de estrafalarias leyes o disposiciones locales sobre moral pública que han existido y existen en Estados Unidos. Muchas de ellas tienen su origen en la puritana Nueva Inglaterra del siglo XVII, pero con el paso del tiempo fueron anuladas o, sencillamente, olvidadas. En realidad todavía figuran sobre el papel, pero dejaron de estar en uso hace tiempo. </p>]]>
        <![CDATA[<p>Aunque no todas. Leyes "ancestrales" prohíben realizar actos sexuales por debajo de cierta edad (en Hawai el listón es el más bajo en  los catorce años) aunque ambos sean menores y se haga de manera consentida. Hacerlo puede significar para el muchacho una pena de tres años de cárcel y figurar durante 25 años en el registro estatal de delincuentes sexuales. En algunos casos la aplicación de la ley ha acabado en suicidio debido al trauma que significaba para un joven de 16 años acabar en prisión y ser declarado "delincuente sexual" al lado de violadores, pederastas o todo tipo de pervertidos. La ola de puritanismo se ceba especialmente con cualquier tipo de manifestación de afecto de vestimenta "indecente". En Little Rock (Arkansas) pueden ser condenadas a hasta 30 días de prisión si son pilladas coqueteando en plena calle. Entonces casi es preferible que se tomen precauciones, como ocurre en Pasadena (California), donde está prohibido que una secretaria esté a solas con su jefe en la misma oficina. Una nueva ley en tramite en Carolina del Sur (que ya se aplica en algunas ciudades del Estado) que multará y sancionará con seis meses de cárcel por llevar pantalones por debajo de la cintura que muestren el tanga o el ombligo.
